Floral Preservation

                                           (“Customer”) wishes to hire Simone’s Timeless Garden for floral preservation services and hereby agrees to the following terms and conditions:

1.    The price for freeze-drying the flowers is non-refundable and is: $                            Simone’s Timeless Garden must receive full payment of this amount prior to processing flowers. One-half of the account balance shall be paid at the time Customer orders display.  Full payment of remaining balance shall be paid by Customer at the time Customer picks-up flowers.

2.    Customer acknowledges that floral preservation is a scientific process and that many factors affect how successful a certain preservation attempt will be. Simone’s Timeless Garden should be consulted in advance regarding Customer’s floral selection.  If Customer chooses not to consult with Simone’s Timeless Garden regarding the specific flowers to be preserved, Simone’s Timeless Garden shall not be in any way responsible if the floral preservation is unsuccessful.  Customer understands and agrees that Customer is responsible for payment of the cost of freeze-drying the flowers, regardless of the results.

3.     Simone’s Timeless Garden is not responsible for damage or loss of flowers due to power failure, fire, flood, equipment failure or any other acts of nature beyond our control.  However, Simone’s Timeless Garden shall immediately notify Customer and may offer to refund Customer’s payment or to replace the flowers, at our discretion.

4.     The date that Customer delivers flowers to Simone’s Timeless Garden is the Reservation Date.  The Reservation Date should be as soon after the event as possible to ensure the best results possible.  Even under the best circumstances, the flowers will change color.  As time passes, the flowers will become softer and more antique looking.

5.     Due to limited space, Customer agrees to pick-up finished flowers within 7 days of notification by Simone’s Timeless Garden.  In the event that Customer has not contacted and/or arranged for pick-up of flowers within 14 days of notification that flowers are completed, Simone’s Timeless Garden shall charge customer a $20 storage fee for each additional week the flowers remain on the premises.  In the event that Customer does not contact Simone’s Timeless Garden within 90 days of notification, Customer’s flowers will be considered abandoned, flowers will become property of Simone’s Timeless Garden and Customer shall have no right to receive monetary reimbursement for flowers nor to receive monies previously paid.

6.     In no event shall Simone’s Timeless Garden become liable to Customer beyond the amount of monies paid by Customer to Simone’s Timeless Garden.  Customer releases Simone’s Timeless Garden for all liability beyond such value.
